Acceptance of Terms

By accessing this website or purchasing any product from Agastya Enterprise, you confirm that:

• You are at least 18 years of age and legally capable of entering into a binding agreement.
• If placing an order on behalf of a business, vessel, or organisation, you have the authority to bind that entity to these Terms.
• You have read, understood, and agree to comply with all terms outlined in this document.

If you do not agree with any part of these Terms, please do not use our website or place any orders with us.

About Agastya Enterprise

Agastya Enterprise is a proprietorship firm engaged in the manufacturing and trade of fishing nets, ropes, and related products, operating from Porbandar, Gujarat, India. The business was founded in 2020 by Chintan Hodar.

We manufacture and supply a range of products including trawling nets, HDPE nets, PP nets, gill nets, and fishing ropes to boat owners, captains, and traders across Gujarat's major fishing harbours.

Products & Orders

We make every effort to accurately describe our products, including mesh size, material, dimensions, and specifications. However, actual products may vary slightly from descriptions due to manufacturing tolerances, material batches, or customisation requirements.

We accept custom orders for specific mesh sizes, net dimensions, rope diameters, and material types. Custom orders are subject to:

• Advance payment or deposit as agreed at the time of order confirmation.
• Lead time of 7–21 working days depending on specifications and quantity.
• No returns or exchanges once production has commenced, unless the product is defective due to manufacturing error.

All orders are confirmed only upon receipt of advance payment or a written/WhatsApp confirmation from our team. Verbal commitments without written follow-up do not constitute a binding order.

All standard products are subject to availability. In case of stock-out, we will notify you and provide an estimated restocking date or offer an alternative.

Pricing & Payment

All prices are quoted in Indian Rupees (INR). Prices are subject to change without prior notice. The price applicable to your order will be the price confirmed at the time of order placement.

We accept the following modes of payment:

• Cash payment at our shop locations in Porbandar, Mangrol, or Okha.
• Bank transfer / UPI / RTGS / NEFT to our registered account.
• Any other mode mutually agreed in writing at the time of order.

Where credit terms have been agreed in writing, payment is due within the agreed credit period. Agastya Enterprise reserves the right to:

• Charge interest on overdue balances at 2% per month.
• Withhold future orders until outstanding dues are cleared.
• Take legal action for recovery of dues under applicable Indian law.

All applicable GST and other government taxes are the responsibility of the buyer and will be included or shown separately in invoices as per prevailing tax laws.

Delivery & Shipping

We primarily serve customers at our shop locations and deliver across Gujarat's major fishing harbours including Porbandar, Mangrol, Okha, Vanakbara, Diu, and Salaya. Outstation delivery may be arranged by mutual agreement.

Standard in-stock products are available for same-day or next-day pickup. Delivery timelines for outstation orders and custom products will be communicated at the time of order confirmation. We are not liable for delays caused by transport partners, weather conditions, or other factors beyond our control.

Delivery charges, if applicable, will be communicated at the time of order and may vary based on weight, distance, and transport mode. These charges are the responsibility of the buyer unless otherwise agreed.

Risk of loss or damage passes to the buyer upon handover of goods to the buyer, their agent, or the transport carrier at our premises or agreed delivery point.

Returns & Refunds

Returns are accepted only in the following cases:

• The product received is materially different from what was ordered and confirmed in writing.
• The product has a manufacturing defect identified at the time of delivery or within 7 days of receipt.
• Wrong product delivered by our error.

• Custom-manufactured nets and ropes made to buyer-specified dimensions.
• Products that have been used, deployed in water, or modified after delivery.
• Products returned after 7 days from date of delivery without prior written notice to us.

To initiate a return, contact us within 7 days of delivery via WhatsApp (70469 85050) or email (Agastyaenterprise22@gmail.com) with details of the issue and photographs of the product. We will review your claim and respond within 3 business days.

Approved refunds will be processed within 7–14 working days via the original mode of payment or via bank transfer as mutually agreed. No cash refunds will be provided for bank transfer payments.

Product Quality & Warranty

Agastya Enterprise takes pride in manufacturing high-quality fishing nets and ropes using premium HDPE and PP materials. Our products are designed for Gujarat's coastal and deep-sea fishing conditions.

All products are inspected before dispatch. We use UV-stabilised, salt-water-resistant materials to ensure longevity under typical fishing conditions.

Our products carry an implied warranty of merchantability for normal fishing use. However, this warranty does not cover:

• Damage caused by misuse, improper storage, or exposure to chemicals not associated with normal fishing.
• Wear and tear from normal use beyond expected product lifespan.
• Damage caused by sharp objects, hooks, propellers, or mechanical equipment.
• Products modified or repaired by parties other than Agastya Enterprise.

All products are sold "as manufactured." We do not guarantee specific catch rates, vessel performance, or fishing outcomes associated with the use of our products.

Intellectual Property

All content on this website — including the Agastya Enterprise brand name, logo, product photographs, text, and design — is the intellectual property of Agastya Enterprise or its proprietor, Chintan Hodar.

• You may not reproduce, copy, distribute, or publish any content from this website without prior written permission.
• Our brand name "Agastya Enterprise" and associated logos may not be used in any commercial, advertising, or promotional context without written consent.
• Unauthorized use of our intellectual property may be subject to legal action under applicable Indian intellectual property laws.

Privacy & Data

When you contact us through our website, WhatsApp, phone, or email, you may share personal information such as your name, phone number, address, and harbour location. This information is used solely to process your enquiry or order.

• We do not sell, share, or transfer your personal information to third parties for commercial purposes.
• Your contact details may be used to send you order updates, product information, or seasonal offers via WhatsApp or phone. You may opt out at any time by informing us directly.
• We implement reasonable precautions to protect your data but cannot guarantee absolute security of electronically transmitted information.

By contacting us or placing an order, you consent to our use of your information as described above.

Limitation of Liability

Agastya Enterprise is not responsible for any loss of catch, vessel damage, personal injury, or financial loss arising from the use of our products, whether or not such loss is related to product quality.

To the maximum extent permitted by applicable Indian law, our total liability to you in connection with any claim shall not exceed the amount paid by you for the specific product that gave rise to the claim.

We are not liable for delays or failures in supply caused by circumstances beyond our reasonable control, including natural disasters, government restrictions, transportation disruptions, raw material shortages, or other force majeure events.

This website is provided on an "as is" basis. We do not guarantee uninterrupted access, accuracy of all information, or freedom from errors. We are not liable for any damages arising from your use of or inability to access this website.

Acceptable Use

When interacting with Agastya Enterprise through any channel — including this website, WhatsApp, phone, or in person — you agree not to:

• Provide false or misleading information when placing an order or making an enquiry.
• Misrepresent your identity or business affiliation.
• Attempt to defraud Agastya Enterprise or its staff in any manner.
• Use our products for any unlawful fishing activities that violate Indian fisheries regulations or government notifications.
• Attempt to reverse-engineer or replicate our proprietary net manufacturing processes or designs.
• Engage in abusive, threatening, or disrespectful conduct toward our staff or representatives.

Violation of any of the above may result in refusal of service and may be reported to relevant authorities.

Termination of Business Relationship

Agastya Enterprise reserves the right to refuse service, cancel pending orders, or terminate any ongoing business relationship with a customer, without prior notice, in the following circumstances:

• Violation of these Terms and Conditions.
• Non-payment of dues beyond agreed credit terms.
• Fraudulent, abusive, or unethical conduct.
• Repeated return of products without valid reason.
• Any activity that may damage the reputation or operations of Agastya Enterprise.

Termination does not relieve the customer of any outstanding payment obligations.

Modifications to Terms

Agastya Enterprise reserves the right to update or modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to this website. The "Last Updated" date at the top of this page will reflect the most recent revision.

We encourage you to review these Terms periodically. Continued purchase of our products or use of our website after any changes constitutes your acceptance of the revised Terms.

Governing Law & Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of India, including the Sale of Goods Act, 1930, the Consumer Protection Act, 2019, and other applicable statutes.

Any disputes arising from these Terms or from any transaction with Agastya Enterprise shall be subject to the exclusive jurisdiction of the courts at Porbandar, Gujarat, India.

Before initiating any legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation. In the event of unresolved disputes, either party may pursue legal remedies available under Indian law.

Nothing in these Terms limits your statutory rights as a consumer under the Consumer Protection Act, 2019, or any other applicable Indian law.
